Erika Jayne’s husband Tom Girardi’s health has declined, according to his lawyers. They claim he is not competent to stand trial due to his failing health.
Girardi was indicted for alleged wire fraud and accused of embezzling $15 million from clients between 2010 and 2020. His brother Robert obtained a conservatorship over him and claimed that a doctor diagnosed him with dementia and late-onset Alzheimer’s disease.
The once-respected attorney and his firm were forced into bankruptcy by creditors. Jayne was also sued for the return of $25 million the firm spent on her bills as part of the bankruptcy.
Girardi was moved into an LA senior living facility in 2021 and then to a facility in Orange County in 2022. Employees at the senior living facility said he now “requires supervision” because of memory deficits and “requires stand-by assistance for all showering/bathing needs.”
The report from Girardi’s senior living facility said he needed reminders to change clothes but has the ability to walk around the facility. He prefers to be alone and doesn’t socialize during meals and activities. In response, the government demanded Girardi be found competent, arguing that their experts determined he could handle a trial.
